1. Acceptance

By accessing or using wellux.in (the “Website”) and/or placing an order, you agree to these Terms & Conditions. If you do not agree, do not use the Website or transact.

3. Eligibility

You must be at least 18 years old and legally capable of contracting. By transacting you represent that your information is accurate, current, and you will maintain it.

4. Orders & Acceptance

Placing an order is an offer to purchase. Order confirmation acknowledges receipt; acceptance occurs when the order is shipped or expressly confirmed. Indogenmed may refuse, cancel, or suspend orders for stock issues, suspected fraud, verification failure, pricing errors, or other legitimate reasons.

5. Pricing & Payment

• Prices shown are as charged and exclusive of duties or import taxes unless indicated at checkout.
• International payments only. No domestic (India) UPI or Indian payment methods are supported.
• Payments are processed through PCI-compliant payment gateway(s) that meet industry standards (including 3D Secure, AVS, CVV verification, and other fraud controls). Payment data is encrypted in transit using TLS 1.2+; sensitive authentication data (full card number, CVV after authorization) is not stored.
• Refunds are subject to approval. Once approved, refunds are issued within 45 calendar days to the original payment method. Chargebacks and disputes follow the process described in the Refund & Dispute Policy.

6. Shipping & Delivery

• Origin: All shipments originate from India.
• Carriers: India Post, DHL, EMS, FedEx, USPS, and other major international logistics providers.
• Estimated delivery: 7–21 business days depending on the selected service (economic, express, or other options presented at checkout).
• Customs & duties: Recipient is responsible for import duties, taxes, and clearance in their country.
• Tracking: Provided when available. Lost or delayed shipments are handled per the Shipping & Dispute Policy.
• Title & risk: Passes as per the shipping terms at checkout.

7. Returns, Refunds & RMA

• Returns are international and subject to approval.
• Return requests must be initiated via support (hello@wellux.in); approved returns receive an RMA authorization. Unauthorized returns may be rejected.
• Return shipping, customs clearance on return, and related logistics are governed case-by-case and communicated during approval.
• Refunds (once the returned item is received and inspected, if applicable) are processed within 45 calendar days of approval.
• Cross-border implications (currency conversion, unrecoverable duties) apply; any non-recoverable import costs are borne by the customer unless otherwise stated.

8. Product Compliance & Disclaimers

• Supplements / Herbal / Cosmetic Products: These products are not intended to diagnose, treat, cure, or prevent any disease. No disease claims are made unless specifically authorized by applicable regulators.
• FSSAI Compliance: Products sold comply with applicable Indian regulations. FSSAI License: 22225099000171.
• Users must follow the usage, storage, and safety instructions on labels. Consult a qualified healthcare professional before using supplements if you have existing medical conditions, are pregnant, nursing, or on medication.
• Any health-related content or product information is for informational purposes; it does not substitute professional medical advice.

9. Intellectual Property

All content on the Website is the property of Indogenmed or its licensors. You may not copy, reproduce, modify, distribute, or create derivative works without express written permission.

10. Prohibited Conduct

You agree not to:

• Use automated tools (scrapers, bots) to access the Website.
• Impersonate others or share account credentials.
• Interfere with security or other users’ access.
• Provide false or misleading information.

Violation may result in suspension or termination.

11. Warranty Disclaimer

The Website and products/services are provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy.

12. Limitation of Liability

To the maximum extent permitted by law, Indogenmed and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or business opportunity. Aggregate liability for any claim shall not exceed ₹1,000 (Indian Rupees One Thousand) or the amount paid for the transaction, whichever is lower.

13. Indemnity

You agree to indemnify and hold harmless Indogenmed, its officers, employees, and agents from any claims, losses, damages, or expenses arising from your breach of these Terms or misuse of the Website.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Exclusive jurisdiction and venue for disputes is in Jaipur, India.

15. Termination

Indogenmed may suspend or terminate access for violations, suspected fraud, or other legitimate reasons. Upon termination, rights granted cease; Indogenmed may delete related data as permitted by law.

16. Privacy

Your data is handled per the Privacy Policy published on the Website. Using the Website constitutes consent to that policy.

19. Miscellaneous

• Severability: Invalid provisions do not affect the remainder.
• Waiver: Failure to enforce is not a waiver.
• Assignment: Indogenmed may assign rights; you may not transfer yours without consent.
